Además, Sogecable, la empresa que maneja la retransmisión de fútbol en la modalidad de pago por visión, ha anunciado que también emprenderá "acciones penales o de cualquier otra naturaleza" contra Mediapro, que ha anunciado su compromiso con 39 clubes de la Liga de Fútbol Profesional para explotar, en exclusiva, a partir del año 2009, sus derechos audiovisuales y de transmisión televisiva. El grupo Mediapro subrayó su distanciamiento con Audivisual Sport, plataforma que actualmente emite los partidos de fútbol de Primera y Segunda, y su futuro control, en exclusiva, de las emisiones de la Liga, después de haber alcanzado un acuerdo con 39 de los 42 clubes de la Liga de Fútbol Profesional. En respuesta a Mediapro, Audiovisual Sport explica en un comunicado que el 24 de julio de 2006 suscribió un contrato con Mediapro, TVC y Sogecable para garantizar la explotación racional y eficiente de los derechos audiovisuales de los partidos de fútbol correspondientes a las competiciones oficiales de Liga y Copa en España durante las temporadas 2006-2007 a 2008-2009 y sucesivas. "Mediapro no puede adquirir derechos" En el citado contrato, se atribuyó a AVS la función y el derecho de negociar y asumir la renovación de los demás contratos que pudieran ir venciendo con posterioridad, por lo que "Mediapro no ha podido, ni puede realizar legítimamente ninguna adquisición de derechos para sí y por su propia cuenta". Una vez finalizada la temporada y dado el reiterado incumplimiento por parte de Mediapro de sus obligaciones de pago y otras, el pasado 3 de julio, AVS demandó judicialmente a esta sociedad para que cumpliera, estricta y fielmente, los compromisos suscritos, y le indemnizara los daños y perjuicios causados. Por ello, AVS procederá al inmediato ejercicio de cuantas acciones de todo tipo le corresponden frente a Mediapro y sus responsables en defensa de sus derechos e intereses legítimos. En el comunicado, Audiovisual Sport "responsabiliza directa y expresamente a Mediapro de los daños y perjuicios que su ilegal actuación haya podido o pueda ocasionar a los clubes de fútbol u otros terceros con los que ilegalmente se haya vinculado, abusando de su buena fe y defraudando conscientemente sus legítimas expectativas". Sogecable lo asume y ataca también a Mediapro Por su parte, Sogecable advirtió que "ejercitará contra el Sr. Roures -dueño de Mediapro- y las demás personas físicas que le auxilien o colaboren en la concepción o ejecución de su plan de defraudación y lesión de los derechos e intereses de Sogecable, las acciones penales o de cualquier otra naturaleza que le corresponden, en caso de que no se produzca una inmediata y pública rectificación de sus manifestaciones y la reparación de sus actuaciones defraudatorias, lesivas y coactivas". Sogecable añade que asume el comunicado realizado por Audiovisual Sport (AVS). La empresa que actualmente asume la retransmisión del fútbol por ppv, ratifica en el comunicado su "compromiso y defensa del vigente modelo de explotación de los derechos audiovisuales de la Liga y Copa y su determinación de defender los derechos e intereses que legítimamente ostenta". Además, recuerda la firma del contrato el 24 de julio del año pasado entre Audiovisual Sport y Mediapro. Sogecable advierte que "no consentirá que se incumplan impunemente los contratos y compromisos de los que, además, Mediapro ha disfrutado durante la temporada 2006-2007 y pretende seguir disfrutando durante la siguiente". Finalmente, alude al Sr. Roures y manifiesta que "ha analizado el contenido de las declaraciones que desvelan sus actuaciones y auténticas intenciones, considerando que sus declaraciones, las conductas en ellas descritas y su difusión pública constituyen hechos susceptibles de ser tipificados como delitos". Mediapro dice que Audiovisual Sport no cumplió "No estamos en Audiovisual Sport, ni vamos a estar con ellos. Es cierto que hubo un acercamiento en un momento dado. Pero no se cumplieron unos acuerdos y asa aproximación se terminó". El responsable de Mediapro añadió que "los condicionantes que tenían que darse para el acuerdo tenían que ver con una fecha para que entráramos a formar parte de la sociedad y eso no ocurrió. Después, el Consejo de Ministros impuso unas condiciones a Audiovisual Sport que coartaba su acción", agregó. "Hubo un incumplimiento del acuerdo por parte de ellos. Por lo tanto, el contrato aquél ya no tiene validez", apuntó Tatxo Benet, directivo de Mediapro. |
